These Terms of Service ("Terms") govern your use of the Tree Care Enterprises website at www.treecareenterprises.com and any related services we provide. They form an agreement between you and Tree Care Enterprises, LLC, an Illinois limited liability company located at 5563 Kilburn Ave, Rockford, IL 61101 ("Tree Care Enterprises," "we," "us," or "our").
1. Acceptance of these Terms
By visiting our website, requesting an estimate, or engaging us for service, you agree to these Terms. If you don't agree, please don't use the site or our services.
2. What we do
Tree Care Enterprises is a tree care company serving northern Illinois (greater Rockford) and southern Wisconsin (Lake Geneva area). Our services include tree pruning, tree removal, plant health care, irrigation, landscaping, lawn maintenance, and snow services. The specific services performed for any customer are defined in that customer's written, signed service agreement.
3. Your responsibilities
When you use our website or interact with us:
- Provide accurate information on forms — your name, address, phone number, and similar details
- Don't use the site for unlawful purposes or in ways that interfere with other users
- Don't attempt to access systems or data that aren't intended for you
4. Estimate requests vs. service agreements
A request submitted through our website is not a contract for service. It's a request for us to contact you and discuss your needs. Actual tree care work begins only after we send you a written service agreement that you sign and return.
5. Payment
Payment terms are governed by your signed service agreement and the invoice we issue for the work performed. Card payments are processed by ProPay; we don't store full card numbers on our systems.
6. Communications consent
By submitting your contact information, you agree we may contact you about your service request and any work we perform — by phone, email, or SMS. SMS-specific terms (including how to opt out and what kinds of messages we send) are described in our SMS Program Terms. You can opt out of any single communication channel at any time without affecting the others (for example, replying STOP to texts doesn't unsubscribe you from email).
7. Intellectual property
All content on our website — text, photographs, illustrations, the Tree Care Enterprises name and logo, and any other branding — is owned by Tree Care Enterprises, LLC or used with permission. You may not copy, reuse, or republish it without our written permission, except that you can share links to our pages.
8. Disclaimer of warranties
The website is provided "as is." Service work is provided according to the terms of your signed service agreement. To the extent allowed by law, we disclaim all other warranties for the website itself — express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the extent allowed by law, Tree Care Enterprises and its owners, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website or our services. Our total liability for any claim arising out of or related to these Terms or the website is limited to the greater of (a) the amount you paid us for services in the 12 months before the claim, or (b) $100. This section doesn't limit our liability where Illinois law prohibits such limits.
10. Indemnification
You agree to indemnify and hold Tree Care Enterprises harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your unlawful use of our website. We agree to act in good faith on your behalf in matters within our control on your service.
11. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
12. Disputes and venue
Any dispute arising out of or related to these Terms or our services that the parties can't resolve informally will be brought exclusively in the state or federal courts located in Winnebago County, Illinois. Both you and Tree Care Enterprises consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the effective date at the top of this page. Continued use of the website or our services after a change means you accept the updated Terms.
14. Severability
If any part of these Terms is found unenforceable, the rest remains in effect.
15. Entire agreement
These Terms — together with the SMS Program Terms, the Privacy Policy, and any signed service agreement between us — are the complete agreement between you and Tree Care Enterprises about the use of the website and our services. They replace any earlier understanding on the same subject.
